White House helps pay for NYPD Muslim surveillance

WASHINGTON (AP) ? The Obama administration said Monday it has no control over how the New York Police Department spends millions of dollars in White House grants that helped pay for NYPD programs that put entire American Muslim neighborhoods under surveillance. In New York, the police commissioner said he wouldn't apologize.
The White House has no opinion about how the grant money was spent, spokesman Jay Carney said. The Associated Press reported Monday that the White House money has paid for the cars that plainclothes NYPD officers used to conduct surveillance on Muslim neighborhoods and paid for computers that stored even innocuous information about Muslim college students, mosque sermons and social events.
The money is part of a little-known grant intended to help law enforcement fight drug crimes. Since the terrorist attacks of Sept. 11, 2001, the Bush and Obama administrations have provided $135 million to the New York and New Jersey region through the High Intensity Drug Trafficking Area program, known as HIDTA. It's unclear exactly how much was spent on surveillance of Muslims because the HIDTA program has little oversight.
The AP confirmed the use of White House money through secret police documents and interviews with current and former city and federal officials. The AP also obtained electronic documents with digital signatures indicating they were created and saved on HIDTA computers. The HIDTA grant program is overseen by the White House Office of National Drug Control Policy.
Carney said the White House drug policy office has no authority to direct, manage or supervise any law enforcement operations, including the NYPD's surveillance of Muslims.
"This is not an administration program or a White House program," Carney said. "This is the New York Police Department."
The disclosure that the White House is at least partially paying for the NYPD's surveillance of Muslim neighborhoods complicates its efforts to stay out of the fray over the controversial counterterrorism programs. Carney described the Office of National Drug Control Policy as a policy office, but he did not say whether the White House sees the NYPD's programs as good policy.
In New York, Police Commissioner Ray Kelly was again unapologetic. Kelly said that some local politicians who questioned the NYPD's methods were pandering to voters in upcoming elections, and said that others ? including New Jersey Gov. Chris Christie, U.S. Sen. Robert Menendez and Newark Mayor Cory Booker ? were wrong to question the department.
"Not everybody is going to be happy with everything the police department does, that's the nature of our business," Kelly said. "But our primary mission, our primary goal is to keep this city safe, to save lives. That's what we're engaged in doing."
The Obama administration has pointedly refused to endorse or repudiate the NYPD programs it helps pay for. It remains unclear whether the White House knew how the NYPD was spending the grant money until the AP asked the White House about it last week.
"We make very clear that we consider Muslim Americans partners in the effort to combat, you know, radical extremism," Carney said Monday. "I think we've made that clear again and again. And that continues to be our position."
John Brennan, Obama's top counterterrorism adviser, last year called the NYPD's efforts "heroic" but would not elaborate. Homeland Security Secretary Janet Napolitano, whose department also gives grant money to the NYPD and is one of the lead federal agencies helping police build relationships with Muslims, has refused in recent months to discuss the police tactics. Tom Perez, the Justice Department's top civil rights lawyer, has repeatedly refused to answer questions about the NYPD.
New York's attorney general, Eric Schneiderman, does not have the authority to investigate the NYPD, Schneiderman's spokesman said. The New York City council has also said it neither has the oversight authority nor expertise to investigate NYPD's counterterrorism programs.
The American Civil Liberties Union and the New York Civil Liberties Union on Monday called for a federal investigation into the White House funds paying for some of the NYPD's counterterrorism activities. So far, the federal government has not decided to investigate the NYPD, despite multiple requests to do so.
Kelly acknowledged Monday that the department uses HIDTA money but would not say how it spends the money.
The White House HIDTA grant program was established at the height of the drug war to help police fight drug gangs and unravel supply routes. It has provided about $2.3 billion to local authorities in the past decade.
After the terror attacks, law enforcement was allowed to use some of that money to fight terrorism. It's unclear how much HIDTA money has been used to pay for the intelligence division, in part because NYPD intelligence operations receive scant oversight in New York.
Congress, which approves the money for the program, is not provided with a detailed breakdown of activities. None of the NYPD's clandestine programs is cited in the New York-New Jersey region's annual reports to Congress between 2006 and 2010. And Congress has not requested that its investigative arm, the Government Accountability Office, look into the HIDTA grant program since 2005.
Most of the money from the White House grants in New York and New Jersey has been spent fighting drugs, said Chauncey Parker, director of the program there. He said less than $1.3 million was spent on vehicles used by the NYPD intelligence unit.
"Those cars are used to collect and analyze counterterrorism information with the goal of preventing a terrorist attack in New York City or anywhere else," Parker said. "If it's been used for specific counterterrorism effort, then it's been used to pay for those cars."
Former police officials told the AP those vehicles have been used to photograph mosques and record the license plates of worshippers.
In addition to paying for the cars, the White House money pays for part of the office space the intelligence division shares with other agencies in Manhattan.
When police compiled lists of Muslims who took new, Americanized names, they kept those records on HIDTA computer servers. That was ongoing as recently as October, city officials said.
Many NYPD intelligence officers, including those that conducted surveillance of Muslim neighborhoods, had HIDTA email addresses. Briefing documents for Kelly, the police commissioner, were compiled on HIDTA computers. Those documents described what police informants were hearing inside mosques and which academic conferences Muslim scholars attended.
When police wanted to pay a confidential informant, they were told to sign onto the HIDTA website to file the paperwork, according to a 2007 internal document obtained by the AP.
Parker said the White House grant money was never used to pay any of the NYPD intelligence division's confidential informants. The HIDTA computer systems, he said, are platforms that allow different law enforcement agencies to share information and work.
"I am shocked to hear that federal dollars may have helped finance the NYPD's misguided efforts to spy on Muslims in America," said Rep. Judy Chu, D-Calif., one of 34 members of Congress who have asked the Justice Department and House Judiciary Committee to investigate the NYPD.
Nermeen Arastu, an attorney with the Asian American Legal Defense and Education Fund, said the White House needs to put its money where its mouth is. She said if the White House promotes outreach to Muslims inside the U.S. and around the world, "why fund a program that basically destroys trust?"
Arastu's organization has filed freedom of information requests at the local and federal level to see how the NYPD's counterterrorism programs are being funded.
The connection between NYPD and the White House anti-drug grant program surfaced years ago, during a long-running civil rights lawsuit against police. Civil rights attorneys asked in court about a "demonstration debriefing form" that police used whenever they arrested people for civil disobedience. The form carried the seal of both the NYPD Intelligence Division and HIDTA.
A city lawyer downplayed any connection. She said the NYPD and HIDTA not only shared office space, they also shared office supplies like paper. The NYPD form with the seal of a White House anti-drug program was "a recycled piece of paper that got picked up and modified," attorney Gail Donoghue told a federal judge in 2003.
The issue died in court and was never pursued further.
Last week, the controversy over NYPD's programs drew one former Obama administration official into the discussion.
After the AP revealed an extensive program to monitor Muslims in Newark, N.J., police there denied knowing anything about it. The Newark police director at the time, Garry McCarthy, has since moved on to lead Chicago's police department where President Barack Obama's first chief of staff, Rahm Emanuel, is now the mayor.
"We don't do that in Chicago and we're not going to do that," Emanuel said last week.
Christie, the New Jersey governor, said the NYPD surveillance in his state was "disturbing" and has asked the attorney general to investigate. Christie was New Jersey's top federal prosecutor and sat on the HIDTA executive board during 2006 and 2007 when the NYPD was conducting surveillance in New Jersey cities. Christie said he didn't know that, in 2007, the NYPD catalogued every mosque and Muslim business in Newark, the state's largest city.
"I kind of think I would have remembered that," he said on Fox Business Network last week.

Winners vs Losers ? Georgette Sullins's Blog
Perhaps you remember a movie that came out in 2005, ?Little Miss Sunshine.? You probably won?t be surprised I was drawn to the title. I do like good news. I do like to dwell on emphasize the positive. I do like daisies and sunflowers and sunshiny stuff. And, I do enjoy children. Now I wasn?t born yesterday, so I prepared my sunny self?s sensibilities. But then, also because I wasn?t born yesterday I opened my heart to embrace this movie.
So I saw that movie and what unfolded was surprisingly uplifting. I watched an ensemble of characters playing out failure after failure. The father, Richard was a failed motivational speaker and at the same time alienating everyone around him. The grandfather seemed the antithesis of a grandfather?bad influence comes to mind. Uncle Frank was a failed, second rate Proustian scholar who had even failed in an attempt to commit suicide. Dwayne lived in his own world making a vow of silence, resolved not to speak to anyone. Sheryl was a mother out of control. And, Olive was a chubby little girl with the dream of winning the tiara of ?Little Miss Sunshine?. Sooo?what was uplifting? The author of the screenplay managed to bring all these characters together in the end.
Michael Arndt?s first big award was the Golden Globe for best original screenplay. Then, he won the Oscar for best original screenplay. I was intrigued to learn more about the author and fascinated by the success of this ?small? low budget film. At youtube I uncovered an interview with him. You can find it here and I recommend viewing it when you have 63 minutes. I?m sorry it?s long, but as the author speaks he shares what he knows?volumes. Treat yourself. If you are a writer, it?s a great listen. (fyi The clip below is only 3 minutes; you may prefer that one and have time for that.)

At the end one can see a complete arc of Richard?s character play out. At first he is hopeful Olive will win. Then he is embarrassed by Olive?s routine. Then he is bewildered not knowing how to react. Finally he joins Uncle Frank and the rest of the family supporting their Olive by dancing with her on stage. The author was focused on a final scene that shows this dysfunctional family connecting. btw Arndt insists this is not autobiographical.
2. The author also, reveals a strategy for solving a dilemma in writing his script. What to do between grandfather?s death and Dwayne?s meltdown? Here again I was intrigued to hear how he solved it. He felt it needed some comic relief precisely there between the two scenes. He reveals to his audience that the answer lay surprisingly close. He explains, ?One doesn?t have to look outside of the action, outside of the setting or outside of the characters to solve a problem in the story/script.? The answer lay in grandpa?s magazines that led to the hilarious and plausible run in with the highway patrolman. Watch the movie if you haven?t already.
3. The author reveals his belief that a work will rise on its own merit. However, it?s important to be true to the work. One can only release it from one?s desk after it?s ready. For Arndt it meant a year of rewriting approximately 7-9 drafts. ?You don?t get a second read in Hollywood,? Arndt cautions.

I get a sense that this screenwriter is committed, writes from the heart and has the skill to transcend the winners vs. losers mentality. For him it is the most natural thing in the world to write a piece about dignity, to dash the winners vs. losers diadem we have created, to rejoice in a family more at peace, unified and connected. The author meets the winners vs. losers mentality head on and his little work, low budget, story of ?failures multiplied? has risen up and achieved the attention it deserves.
A few years later after ?Sunshine?, there was another win in store for Arndt. No, he didn?t win another Oscar, but his collaborative script for ?Toy Story 3? earned him a nomination last year for the 2011 Oscars. There are no nominations for him this year. But my eyes are still on this young screenwriter whose future script(s) will bubble up, and rise on its/their own merit.

Bravo to the Hoovers who stood up together and supported their Olive.

Laurie McCabe of SMB Group - Small Business Trends
In recent years, the economic situation has created a new wave of ?accidental entrepreneurs.??There are now more small businesses than ever seeking the key to business growth and recent reports indicate that some may have just found it. With many small businesses tightening up their purse strings, there are those that are focusing their spending where they think it will pack the biggest punch ? IT progression. Laurie McCabe joins Brent Leary to share her recent findings on the topic.

Small Business Trends: Can you tell us a little bit about your background?
Laurie McCabe: Basically my partner, Sanjeev Aggarwal, and I founded the SMB Group about two and a half years ago.? We both have been analyst and researchers in the technology industry for quite a while. We decided we really wanted to concentrate on the small and medium business segment and their needs; helping vendors to serve small and medium businesses better, with better solutions.? That is what we are all about and that is what we do.
Small Business Trends:?Let?s talk about your technology predictions for 2012.???Economic Anxiety Lowers SMB Revenue Expectations?? and ?SMB IT Progressive Class Gains Ground.?? Can you?talk about those two?
Laurie McCabe: Yes, those were the two I definitely wanted to combine.? Basically the first one is about small businesses?being skittish in terms of their own revenue performance going forward this year and consequently tightening up?on their?wallets.
In the study, we found that these small businesses are getting a little bit bullish again.? But in 2011, there was other issues happening.??I think a lot of the worries and uncertainties came back and caused a damper. For instance, in 2011 we found about three quarters of small businesses surveyed expected growth.? Looking ahead for 2012, we found only 56% were looking for growth. That means that they were also cutting back a little on their IT spending.
There is this category or segment of small businesses we call progressive IT SMB?s. This category plans to increase IT. What distinguishes them is they see technology as really critical for business growth and business transformation. Whether it is helping them open up a new market, create a competitive advantage, or level the playing field against companies, they view technology as going hand and hand enabling them to do that.
I think that in looking at those two things what we?might take away is that these IT progressive companies can?open up a pretty big gap among the companies that are not investing and are not really looking at IT strategically.
Small Business Trends: What percentage of the SMB Class or the SMB Segment would you put in that SMB progressive class?
Laurie McCabe: I think about 20% or so. But we always find a difference between small and medium in terms of their sophistication and their thought process, in terms of using IT strategically for their business.? It is probably more in medium business, but you know it is not a huge majority by any means.
Small Business Trends: Can you?talk about the #2 that you picked out for us today?

Laurie McCabe: Yes.? The biggest theory that we see, and the biggest one for gains going forward, are things like marketing automation, business intelligence, and that big category of CRM.
Interestingly, we see a pretty good pickup in things like desktop virtualization solutions.? Not everybody wants to have everything in a public Cloud. They like the application that they are using but they just want to have it hosted and managed in a virtual desktop environment. For some companies, that can be a great way to get rid of all of the hassles of managing all of these systems.
Small Business Trends:?Can you tell us about the Accidental Entrepreneur?
Laurie McCabe: Basically, the number of people that are becoming entrepreneurs is really growing. The U.S. Census Bureau said that small businesses without a payroll make up more than 70% of America?s 27 million companies with annual sales of $887 billion.
Because the recession was so horrible, a lot of people got laid off and could not find jobs.? There are a lot of entrepreneurs today that never intended to become entrepreneurs. They just decided that they needed to make some money.? A lot of them have stayed solo because they realize they like that better then going back on the corporate payroll.? In some cases, the unemployment situation is so bad and employment options are limited.
I think some of them may have the desire to grow the company and become an employer business.? But I think a lot of them really have no desire to hire and manage employees and have that kind of business model.
We think this class of accidental entrepreneurs is spiking the demand for applications and services that will help them grow the business in terms of revenue and profitability without any employees. It does not mean that a one person business will be a five million dollar company.? Instead of making $50,000 to $60,000, you will grow to making $100,000 by automating things and doing things smarter.

Matsuzaka threw a bullpen session yesterday for the first time since going under the knife in June, tossing around 20 pitches at the Red Sox?s spring training complex in Florida.
Afterward he called it ?a warmup? and said he expects to ?throw harder next week.?
He?ll likely be limited to bullpen sessions and long-tossing for a while, as even an optimistic timetable for Matsuzaka?s recovery wouldn?t have him returning to game action before midseason. And given his 5.03 ERA and terrible walk rates since going 18-3 with a 2.90 ERA in 2008 the Red Sox aren?t exactly motivated to rush him back in the final season of a six-year, $52 million contract.

UN says Duvalier must be tried for Haiti abuses (AP)
GENEVA ? The U.N.'s human rights office has sharply criticized a Haitian judge's recommendation against trying former dictator Jean-Claude Duvalier for alleged crimes against humanity and other rights abuses.
A spokesman for the U.N.'s High Commissioner for Human Rights says Duvalier must be tried for "very serious human rights violations" during his 15-year reign that were "extensively documented."
Rupert Colville said Tuesday the U.N. is "extremely disappointed" by Investigative Magistrate Carves Jean's decision Monday to recommend that the ruler once known as "Baby Doc" face trial only on corruption charges.
He says that under international law there is no statute of limitations for crimes such as torture, false imprisonment and murder.
